Through our Website, Assista participating healthcare professionals including a) a third-party service provider including (i) Offering medical consultancy services as a third-party independent doctor (“Medical Practitioner”) (ii) Dispensing of pharmaceutical products as a third-party pharmacy (“Third-Party Pharmacies”); (iii) Diagnostic services being offered as a third-party diagnostic centre (“Third-Party Labs”). The Third-Party Pharmacies, Third-Party Labs, and Medical Practitioner are collectively referred to as the “Third-Party Service Providers” “You” or “Your” or “Yourself” or “User” (The services provided by Third Party Service Providers are collectively referred to as the “Third-Party Services”) b) A patient, his/her representatives, or affiliates, benefited from healthcare services through the Website (“End-User,” “You” or “User”); or c) Otherwise, a user of the Website (“You” or “User”).
BY CONFIRMING THAT YOU ARE BOUND BY THIS PRIVACY POLICY (BY THE MEANS PROVIDED ON THIS WEBSITE), BY USING THE SERVICES OR BY OTHERWISE GIVING US YOUR INFORMATION, YOU AGREE TO THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY AND YOU HEREBY CONSENT TO OUR COLLECTION, USE AND SHARING OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. 1. ACCESS
We collect Your Personal Information directly from You, from third-parties and automatically through the Our Services. This Personal Information, for instance, would relate to the type of device You are using, the time that You have logged on to Our Services, Your IP address, and other Personal Information as listed in Clause 5 below.
You may access the Personal Information shared by You with Us, in the manner given below. You can further choose to share additional Personal Information with Us and you can modify your personal data.
We keep in mind that the Personal Information shared by You is accessible to You. You can write to Us at the email id specified in Clause 15.

You acknowledge that You have provided Your Personal Information out of your free will and after understanding how it will be used. However, we shall not be liable for any loss that may happen to you owing to the provision of wrongful Personal Information by You.
We will share personal information outside of Assista only when we have your consent. We will ask for your explicit consent to share any sensitive personal information.
3. CONTROL OVER YOUR PERSONAL INFORMATION
You have the right to withdraw Your consent at any point, provided such withdrawal of the consent is intimated to us in writing through an email at contact@assistahealth.in requesting the same. If You wish to rectify the Personal Information that we may have collected to offer You personalized services and offers, as per Clause 12 of this Policy, you may write to us, as mentioned under Clause 15 of this Policy, citing the reason for such rectification of Personal Information.
Once You withdraw Your Consent to share the Personal Information collected by Us, We shall have the option not to fulfil the purposes for which the said Personal Information was sought and We may restrict you from using our Services or the Website.
4. CHANGES TO THE PRIVACY POLICY
We reserve the right to change this Privacy Policy from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We always indicate the date when the last changes were published and we will offer access to archived versions for your review. g) Physical, physiological and mental health condition, provided by You and/or your Health Care Professional,
h) Personal medical records and history,
i) Valid financial information at time of purchase of product/service and/or online payment,
j) Login ID and password,
k) User details as provided at the time of registration or thereafter,
l) Records of interaction with Assista representatives,
m) Your usage details such as time, frequency, duration and pattern of use, features used and the amount of storage used,
n) Master and transaction data and other data stored in Your user account.
o) Any other information that is willingly shared by You (collectively referred to as “Personal Information”),
p) Sexual orientation,
q) Biometric information,
r) Information received by body corporate under lawful contract or otherwise,
s) Call data records.
Information that is freely available in the public domain or accessible under the Right to Information Act, 2005 or any other law will not be regarded as personal information or sensitive personal data or information.

The methods by which we collect your Personal Information include but are not limited to the following:

b) When You provide details to a Health Care Professional or Assista representative
c) When You register, use or receive Our Services
d) When you provide access to any other website
e) By the use of cookies (more fully detailed in Clause 9 of this Privacy Policy
7. PRIVACY STATEMENTS
7.1 Privacy Statements for All Users
This section applies to all Users
7.1.1 Accordingly, a condition of each User’s use of and access to the Services is their acceptance of the Terms of Use, which also involves acceptance of the terms of this Privacy Policy. Any User that does not agree with any provisions of the same has the option to discontinue the Services provided by Assista immediately.
7.1.2 All the information provided to Assista by a User, including sensitive personal information, is voluntary. You understand that Assista may use certain information of yours, which has been designated as ‘sensitive personal data or Information’ under the SPI Rules, (a) for the purpose of providing you the Services, (b) for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, for (c) for sale or transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates. Assista also reserves the right to use information provided by or about the End-User for the following purposes:
(a) Publishing such information on the Website.
(b) Contacting End-Users for offering new products or services.
(c) Contacting End-Users for taking product and Service feedback.
(d) Analysing software usage patterns for improving product design and utility.
(e) Analysing anonymized practice information for commercial use.
You hereby consent to such use of such information by Assista.
7.1.3 Collection of information which has been designated as ‘sensitive personal data or Information’ under the SPI Rules requires your express consent. By affirming your assent to this Privacy Policy, you provide your consent to such collection as required under applicable law. Our Services may be unavailable to you in the event such consent through an email is not given.
7.1.4 Assista does not control or endorse the content, messages or information found in any Services created by You and, therefore, Assista specifically disclaims any liability with regard to the Services and any actions resulting from your participation in any Services, and you agree that you waive any claims against Assista relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against Assista relating to same.
7.1.5 You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If your personal information changes, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through support@assistahealth.in. We will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable. If you provide any information that is untrue, inaccurate, out of date or incomplete (or becomes untrue, inaccurate, out of date or incomplete), or Assista has reasonable grounds to suspect that the information provided by you is untrue, inaccurate, out of date or incomplete, Assista may, at its sole discretion, discontinue the provision of the Services to you.
7.1.6 You may choose to unsubscribe from promotional communications that you receive from Assista by clicking the ‘unsubscribe’ link provided at the end of every such promotional communication.
7.1.7 If you wish to cancel your account or request that we no longer use your information to provide you services, contact us through support@assistahealth.in. We will retain your information for as long as your account with the Services is active and as needed to provide you the Services. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After a period of time, your data may be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes.
7.1.8 If you wish to opt-out of receiving non-essential communications such as promotional and marketing-related information regarding the Services, please send us an email at support@assistahealth.in
7.1.9 Assista may require the User to pay with a credit card, wire transfer, debit card, UPI or cheque for Services for which subscription amount(s) is/are payable. Assista will collect such User’s credit card number and/or other financial institution information such as bank account numbers and will use that information for the billing and payment processes, including but not limited to the use and disclosure of such credit card number and information to third parties as necessary to complete such billing operation. Verification of credit information, however, is accomplished solely by the User through the authentication process. User’s credit-card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. However, Assista provides you an option not to save your payment details. User is advised, however, that internet technology is not full proof safe and User should exercise discretion on using the same.
7.1.10 Due to the communications standards on the Internet, when a User or the End-User or anyone who visits the Website, Assista automatically receives the URL of the site from which anyone visits. Assista also receives the Internet Protocol (IP) address of each User’s computer (or the proxy server a User used to access the World Wide Web), User’s computer operating system and type of web browser the User is using, email patterns, as well as the name of User’s ISP. This information is used to analyse overall trends to help Assista improve its Service. The linkage between User’s IP address and User’s personally identifiable information is not shared with third parties. Notwithstanding the above, Assista may share some of the aggregate findings (not the specific data) in anonymized form (i.e., non-personally identifiable) with advertisers, sponsors, investors, strategic partners, and others in order to help grow its business.
7.1.11 The Website uses temporary cookies to store certain data (that is not sensitive personal data or information) that is used by Assista and its service providers for the technical administration of the Website, research, and development, and for User administration. In the course of serving advertisements or optimizing services to its Users, Assista may allow authorized third parties to place or recognize a unique cookie on the User’s browser. The cookies however, do not store any personal information of the User.
7.1.12 To avail a service a User has to create an account, a User is required to provide the information through which User recognizes and expressly acknowledges is personal information allowing others, including Assista, to identify the User. Assista may, in future, include other optional requests for information from the User to help Assista to customize the Website to deliver personalized information to the User. However, Assista assumes your consent in relation to various matters, once you complete the registration process.
7.1.13 This Privacy Policy applies to Services that are owned and operated by Assista. Assista does not exercise control over the sites displayed as search results or links from within its Services. These other sites may place their own cookies or other files on the Users’ computer, collect data or solicit personal information from the Users, for which Assista is not responsible or liable. Accordingly, Assista does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor does Assista guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages, or other materials available on such websites. The inclusion or exclusion does not imply any endorsement by Assista of the website, the website's provider, or the information on the website. If you decide to visit a third-party website linked to the Website, you do this entirely at your own risk. Assista encourages the User to read the privacy policies of that website.
7.1.14 The Service may enable User to communicate with other Users or to post information to be accessed by others, whereupon other Users may collect such data. Such Users, including any moderators or administrators, are not authorized Assista representatives or agents, and their opinions or statements do not necessarily reflect those of Assista, and they are not authorized to bind Assista to any contract. Assista hereby expressly disclaims any liability for any reliance or misuse of such information that is made available by Users or visitors in such a manner.
7.1.15 An authorized Assista representative or agent may communicate with User and collect information to share with other Users. Whereupon other Users may collect such data and communicate with authorized Assista representative or agent or with initial user from whom information was collected. Assista may act as a mediator between Users to transfer the information and Users opinions or statements do not necessarily reflect those of Assista, and they are not authorized to bind Assista to any contract. Assista hereby expressly disclaims any liability for any reliance or misuse of such information that is made available by Users in such a manner.
7.1.16 Assista does not collect information about the visitors of the Website from other sources, such as public records or bodies, or private organisations, save and except for the purposes of registration of the Users (the collection, storage, and disclosure of which each End User must agree to under the terms of use in order for Assista to effectively render the Services).
7.1.17 Assista maintains a strict "No-Spam" policy, which means that Assista does not intend to sell, rent, or otherwise give your e-mail address to a third party without your consent.
7.1.18 Assista has implemented best international market practices and security policies, rules, and technical measures to protect the personal data that it has under its control from unauthorised access, improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss. However, for any data loss or theft due to unauthorized access to the User’s electronic devices through which the User avails the Services, Assista shall not be held liable for any loss whatsoever incurred by the User.
7.1.19 The reasonable security practices and procedures implemented by Assista include but are not limited to: encrypting data when it is on the move using industry standard practices, keeping all the data within private cloud, secure and very limited access to all production servers, performing regular security updates on our servers and more.
7.1.20 Assista takes your right to privacy very seriously and other than as specifically stated in this privacy Policy, will only disclose your personal information in the event it is required to do so by law, rule, regulation, law enforcement agency, governmental official, legal authority or similar requirements or when Assista, in its sole discretion, deems it necessary in order to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply the Terms of Use.
7.2 Privacy Statements for Healthcare Professionals
This section applies to all Healthcare Professionals
7.2.1 As part of the registration as well as the form filling and submission process that is available to Healthcare Professionals on Assista, certain information, including sensitive personal data or information is collected from the Healthcare Professionals.
7.2.2 All the statements in this Privacy Policy apply to all Healthcare Professionals, and all Healthcare Professionals are therefore required to read and understand the privacy statements set out herein prior to submitting any sensitive personal data or information to Assista, failing which they are required to leave the Services, including the Website immediately.
7.2.3 Healthcare Professionals personally identifiable information, which they choose to provide to Assista, is used to help the Healthcare Professionals describe and identify themselves. This information is exclusively owned by Assista. Assista may use such information for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis, and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates. Assista also reserves the right to use information provided by or about the Healthcare Professionals for the following purposes:
a) Publishing such information on the Website.
b) Contacting Healthcare Professionals for offering new products or services
c) Contacting Healthcare Professionals for taking product feedback
d) Analysing software usage patterns for improving product design and utility
e) Analysing anonymized practice information including financial, and inventory information for commercial use
7.2.4 Assista automatically enables the listing of Healthcare Professionals information on its Website using its software. The Healthcare Professionals information listed on Website is displayed when End-Users search for Service. Any personally identifiable information of the Healthcare Professionals listed on the Website is not generated by Assista and is provided to Assista by Healthcare Professionals who wish to enlist themselves on the Website, or is collected by Assista from the public domain. Assista displays such information on its Website on an as-is basis making no representation or warranty on the accuracy or completeness of the information. Assista will, however, take reasonable steps to ensure the accuracy and completeness of this information.
7.3 Privacy Statements for End Users
This section applies to all End-Users.
7.3.1 As part of the registration/application creation and submission process that is available to End-Users on this Service, certain information, including sensitive personal data or information is collected from the Users.
7.3.2 All the statements in this Privacy Policy apply to all End-Users, and all End-Users are therefore required to read and understand the privacy statements set out herein prior to submitting any sensitive personal data or information to Assista, failing which they are required to leave the Assista immediately.
7.3.3 If you have inadvertently submitted any such information to Assista prior to reading the privacy statements set out herein, and you do not agree with the manner in which such information is collected, stored, or used, then you may access, modify, and delete such information by using options provided on the Website or Application. In addition, you can, by sending an email to support@assistahealth.in, inquire whether Assista is in possession of your personal data, and you may also require Assista to delete and destroy all such information.
7.3.4 End-Users’ personally identifiable information, which they choose to provide on the Service is used to help the End-Users describe/identify themselves. Other information that does not personally identify the End-Users as an individual, is collected by Assista from End-Users (such as, patterns of utilization described above) and is exclusively owned by Assista. Assista may also use such information in an aggregated or non-personally identifiable form for research, statistical analysis, and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates. In particular, Assista reserves with it the right to use anonymized End-User demographics information and anonymized End-User health information for the following purposes:
a) Analysing software usage patterns for improving product design and utility
b) Analysing such information for research and development of new technologies
c) Using analysis of such information in other commercial product offerings of Assista
d) Sharing analysis of such information with third parties for commercial use
7.3.5 Assista will communicate with the End-Users through email, messages, phone, and notices posted on the Website or through other means available through the service, including text and other forms of messaging. The End-Users can change their phone number and contact preferences at any time by logging into their "Account" at www.assistahealth.in and changing the personal details.
7.3.6 Assista Website and Services are not intended for use by minors, Assista respects the privacy of minors who may inadvertently use the internet or the mobile application. If you use the services on behalf of someone else including but not limited to minors or dependents, you represent that you are authorised by such individual to accept this privacy policy on such individual’s behalf.
7.3.7 At times, Assista conducts a User survey to collect information about End-Users' preferences. These surveys are optional and if End-Users choose to respond, their responses will be kept anonymous. Similarly, Assista may offer contests to qualifying End-Users in which we ask for contact and demographic information such as name, email address and mailing address. The demographic information that Assista collects in the registration process and through surveys is used to help Assista improve its Services to meet the needs and preferences of End-Users. This may include targeting advertising to End-Users about our Services.
7.3.8 Assista may keep records of electronic communications and telephone calls received and made for making appointments or other purposes for the purpose of administration of Services, customer support, research, and development and for better listing of Healthcare Professionals.
7.3.9 All Assista employees and data processors, who have access to, and are associated with the processing of sensitive personal data or information, are obliged to respect the confidentiality of every End-Users’ sensitive personal data and information.
7.3.10 Assista may also disclose or transfer End-Users’ personal and other information a User provides, to a third party as part of reorganization or a sale of the assets of a Assista corporation division or company. Any third party to which Assista transfers or sells its assets to will have the right to continue to use the personal and other information that End-Users provide to us, in accordance with the Terms of Use.
7.3.11 To the extent necessary to provide End-Users with the Services, Assista may provide their personal information to third party contractors who work on behalf of or with Assista to provide End-Users with such Services, to help Assista communicate with End-Users or to maintain the Website. Generally, these contractors do not have any independent right to share this information, however certain contractors who provide services on the Website, including the providers of online communications services, will have rights to use and disclose the personal information collected in connection with the provision of these Services in accordance with their own privacy policies.
7.4 Privacy Statements for Casual Visitors
7.4.1 No sensitive personal data or information is automatically collected by Assista from any casual visitors of this website, who are merely perusing the site.
7.4.2 Nevertheless, certain provisions of this Privacy Policy are applicable to even such casual visitors, and such casual visitors are also required to read and understand the privacy statements set out herein, failing which they are required to leave this website immediately.
7.4.3 If you, as a casual visitor, have inadvertently browsed any other page of this Website prior to reading the privacy statements set out herein, and you do not agree with the manner in which such information is obtained, stored, or used, merely quitting this browser application should ordinarily clear all temporary cookies installed by Assista. 8. SHARING AND TRANSFERRING OF PERSONAL INFORMATION
Once you have freely consented to share your Personal Information with us, You authorize us to exchange, transfer, share, part with all or any of Your Personal Information, across borders and from Your country to any other countries across the world with the Cloud Service Provider and Our affiliates / agents / third party service providers / partners / banks and financial institutions or any other persons, for the Purposes specified under this Policy or as may be required by applicable law.
You acknowledge that some countries where we may transfer Your Personal Information may not have data protection laws that are as stringent as the laws of Your own country. You acknowledge that it is adequate that when Assista transfers Your Personal Information to any other entity within or outside Your country of residence, Assista will place contractual obligations on the transferee which will oblige the transferee to adhere to the provisions of this Privacy Policy.
9. USE OF COOKIES
We may store temporary or permanent ‘cookies’ on your computer. You can erase or choose to block these cookies from your computer. You can configure your computer’s browser to alert you when we attempt to send you a cookie with an option to accept or refuse the cookie. If you have turned cookies off, you may be prevented from using certain features of the Website. In the course of displaying advertisements regarding its services or optimizing services to its Users, Assista may allow authorized third parties to place or recognize a unique cookie on the User’s browser/device. Assista does not store personally identifiable information in the cookies. Further, Assista does not exercise control over the sites displayed as search results or links from within its Services. These other sites may place their own cookies or other files on Your computer, collect data or solicit personal information from You, for which Assista is not responsible or liable. 10. SECURITY
The security of your Personal Information is important to us. We have adopted reasonable security practices and procedures including role-based access and need to know basis, password protection, encryption etc. to ensure that the Personal Information collected is secure. We restrict access to your Personal Information to Our and Our affiliates’ employees, agents, third party service providers, partners, and agencies on a need-to-know basis and in relation to the Purposes as specified above in this Policy.
No administrator at Assista will have knowledge of your password. It is important for you to protect against unauthorized access to your password, your computer, your mobile phone, or any other device. Be sure to log off from the Website or Application when finished. Assista does not undertake any liability for any un-authorised use of your account and password. If you suspect any unauthorized use of your account, you must immediately notify Assista by sending an email to support@assistahealth.in You shall be liable to indemnify Assista due to any loss suffered by it due to such unauthorized use of your account and password.
While We will endeavour to take all reasonable and appropriate steps to keep secure any information which We hold about You and prevent unauthorized access, you acknowledge that the internet is not 100% secure and that We cannot provide any absolute assurance regarding the security of Your Personal Information. Notwithstanding the above, Assista is not responsible for the confidentiality, security, or distribution of your personal information by our partners and third parties outside the scope of our agreement with such partners and third parties. Further, Assista shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond the reasonable control of Assista including, acts of government, computer hacking, unauthorised access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of Internet service or telephone service of the User etc.
11. THIRD-PARTY REFERENCES AND LINKS
During Your interactions with Us, it may happen that We provide/include reference to third parties or fiduciaries, and/or links and hyperlinks of third-party websites. It may also happen that you include links and hyperlinks of third-party websites. The reference of such third parties or listing of such third-party external sites (by You or by Us) does not imply endorsement of such party or site by Assista. Such third parties and third-party sites are governed by their own terms and conditions. We do not make any representations regarding the availability and performance of any of the third parties or third-party sites. We are not responsible for the content, terms of use, privacy policies and practices of such third-party websites.
